Terms of Service

These Terms govern your use of the Hudson Real Estate LLCwebsite and tenant portal (“the Services”). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

Important: These Terms cover the website and tenant portal only. Your actual tenancy — rent amount, security deposit, maintenance obligations, late fees, lease duration, and every other right and obligation between tenant and landlord — is governed by your separate written lease agreement and Texas Property Code. If anything in these Terms conflicts with your lease, the lease controls.

Who We Are

Using the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You specifically agree not to:

  • Access or attempt to access accounts, properties, or data that do not belong to you.
  • Attempt to probe, scan, or test vulnerabilities of the Services; circumvent authentication or security; or otherwise interfere with normal operation.
  • Scrape, harvest, or automate access to the Services without our written permission.
  • Upload malware, illegal content, or content that infringes the rights of others.
  • Impersonate another person or misrepresent your affiliation with any person or entity.

Tenant Portal Accounts

Tenant portal accounts are created by us and linked to your lease. You are responsible for:

  • Keeping the contact and payment information associated with your account accurate and up to date.
  • Keeping your sign-in credentials confidential and notifying us promptly if you suspect unauthorized access.
  • All activity that occurs under your account.

We use passwordless sign-in links sent to the email address on file. Anyone with access to that email inbox can sign in to your portal account — secure your email accordingly.

Payments

Rent and other charges owed under your lease may be paid through the portal using our payment provider, Stripe. The amount, due date, grace period, and late fees are set by your lease and Texas Property Code §92.019, not by these Terms.

  • Payment method. You authorize the payment method you register (bank account or card) to be charged for the amounts you schedule or confirm.
  • Returned payments. Returned or failed payments may be subject to a returned-payment charge and to late fees as specified in your lease.
  • Refunds and disputes. Rent refunds and credits are handled according to your lease and Texas law. Payment-card disputes go through Stripe first; we will work with you to resolve any legitimate issue promptly.

Maintenance Requests

Non-emergency maintenance requests are submitted through the portal. Response times depend on the nature of the issue and vendor availability. For emergencies — flooding, gas leaks, no heat or AC, fire, security — call 214-316-2910 immediately; if a 911-level risk exists, call 911 first. Submitting a portal request does not substitute for an emergency call.

Intellectual Property

The website, tenant portal, brand, logo, and content are owned by Hudson Real Estate LLC or our licensors and are protected by copyright and trademark law. You may view and use the Services for their intended purpose but may not copy, redistribute, modify, or create derivative works without our permission.

Third-Party Services

The Services rely on third parties — notably Stripe (payments), Supabase (hosting and authentication), Resend (email), and Vercel (application hosting). Each provider has its own terms and privacy practices. We are not responsible for third-party outages or errors outside our control, but we will work to resolve disruptions promptly.

Disclaimers

The Services are provided “as is” and “as available.” We do not guarantee the Services will be uninterrupted, error-free, or secure, and we disclaim all implied warranties to the fullest extent allowed by law. This disclaimer does not limit our obligations as a landlord or property manager under your lease or Texas Property Code.

Limitation of Liability

To the fullest extent allowed by law, Hudson Real Estate LLC is not liable for indirect, incidental, consequential, or special damages arising out of your use of the Services. This does not limit any right you have under Texas Property Code or your lease.

Termination

We may suspend or terminate tenant portal access in cases of misuse, unauthorized access, unpaid balances in default, or after the end of your lease. Termination of portal access does not terminate your lease or any outstanding obligations.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws principles. Disputes will be resolved in the state or federal courts located in Texas.

Changes

We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Continued use of the Services after a change constitutes acceptance of the updated Terms. Material changes will be communicated to active tenants by email.
